Warranty coverage (EU/GB)

Racemore Simulator’s warranty obligations are limited to the terms set forth below: Racemore Simulator warrants this hardware part against defects in materials and workmanship under normal use for a period of TWO YEAR (730) DAYS and commercial use for a period of ONE YEAR (365) DAYS from the date of retail purchase by the original end-user purchaser (the “Warranty Period”). In any case of failure due to manufacturing or material defect, we will be obligated to perform a repair. Every electrical component, seat and belts are warranted by their respective manufacturers. The warranty for commercial use of these components may differ.

Racemore Simulator does not provide any warranty whatsoever, express or implied, with respect to normal wear and tear, accidents, viruses, self-installed software, after-market products, modified Racemore Simulator products (except those which were modified by Racemore Simulator) or on any item, including software, hardware or component parts, not manufactured by or for Racemore Simulator, and other exceptions as set forth below.

All warranties become null and void if the hardware component is opened for any reason, including for attempts at repair, unless performed by the manufacturer or as directed by and under the supervision of Racemore Simulator. If a warranty defect arises and a valid claim is received by Racemore Simulator within the Warranty Period, Racemore Simulator will, in its sole and unfettered discretion, and at its sole option, either (1) exchange the part with a new, used or refurbished part that is at least functionally equivalent to the original part, or (2) refund the purchase price of the part.

A replacement part shall have the warranty remaining on the original part. When a part is exchanged, any replacement item becomes your property and the replaced item becomes Racemore Simulator’s property. When a refund is given, the part(s) for which the refund is provided becomes property of Racemore Simulator.

Exclusions and limitations

This Limited Warranty applies only to software developed by or for, and hardware parts manufactured by or for Racemore Simulator. The Limited Warranty does not apply to any modifications of any kind, including the modification, alteration, addition or removal of any hardware part or any software added by the retailer, consumer or end user, even if packaged or sold with Racemore Simulator hardware. Manufacturers and suppliers other than Racemore Simulator may provide their own warranties, but Racemore Simulator, to the extent permitted by law, provides its parts on an “as is” basis. Self-installed software, including without limitation system software, is not covered under this Limited Warranty. Simulator software is covered by a software warranty issued by the manufacturer thereof. Racemore Simulator does not separately warranty any software. Racemore Simulator does not warrant that the operation of the part will be continuous or entirely free of defects or errors. Racemore Simulator is not responsible for any damage arising from failure to follow instructions relating to the part’s use.

This warranty does not apply:
a) to damage caused by products not manufactured by Racemore Simulator;
b) to damage caused by normal wear and tear, accident, abuse, misuse, flood, fire, earthquake or other external causes;
c) to damage caused by operating the part outside the permitted uses described by Racemore Simulator;
d) to damage caused by alterations, modifications or adjustments to the product or its subcomponent parts, or by service (including upgrades and expansions) performed by anyone who is not a representative of Racemore Simulator;
e) to a part that has been altered, modified or adjusted such that it produces a change in the functionality or capability of the product in any way;
f) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship;
g) if any serial number has been removed or defaced;
h) to retailers;
i) if the product is made available for general, mass, public or commercial use, whether or not for profit or in exchange for any other benefit conferred;
j) if the hardware has been opened for any reason, including for attempts at repair, except those performed by the manufacturer or as directed by and under the supervision of Racemore Simulator.

All Racemore hardware products carry a Limited Warranty against defects in materials and workmanship. You may review a copy of the Limited Warranty on new products, including its limitations and exclusions, before you purchase, by browsing to our support page.

By purchasing from Racemore, whether you place your order online or by telephone, you acknowledge that you have had an opportunity to review Racemore’ warranty terms, have done so to the degree you need to be familiar with them, and you accept their terms and conditions, including the limitations, exclusions, and disclaimers in them.

Non-Racemore-branded, third-party products are, to the greatest extent permitted by law, sold “AS IS” by the Racemore Store, but may be accompanied by their manufacturers’ standard warranties. Racemore sells “AS IS” products as is, where is, and with all faults, and without express or implied warranties from Racemore.

Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the disclaimers, exclusions or limitations may not apply to you, and you might have additional rights.

Products sold through the Racemore Store that do not bear the Racemore Brand name are serviced and supported exclusively by their manufacturers in accordance with any terms and conditions packaged with the products (unless the third-party product is pre-installed in an Racemore-branded computer). Racemore’ Limited Warranty does not apply to products that are not Racemore-branded, even if packaged or sold with Racemore products. Please contact the manufacturer directly for technical support and customer service.

Return and refund policy

If you are not satisfied with your Racemore purchase of a product, please email info@racemore.com for a Return Material Authorization (RMA) request within 14 calendar days of the receipt of the product. Configure-to-order, personalized or other customized products may not be returned for refund or exchange under any circumstances unless such product is Dead on Arrival (see the section below for more detailed information on such Dead on Arrival products). If the item is returnable and you send it back to us unopened in the original box, Racemore will exchange it or offer you a refund based on your original method of payment. You must return the product to the Racemore warehouse within 14 calendar days of the issuance of the RMA. All products must be packed in the original, unmarked packaging including any accessories, manuals, documentation and registration that shipped with the product.

NOTE: Racemore recommends that you (1) use a carrier that offers shipment tracking for all returns and (2) either insure your package for safe return to Racemore or declare the full value of the shipment so that you are completely protected if the shipment is lost or damaged in transit. If you choose not to (1) use a carrier that offers tracking or (2) insure or declare the full value of the product, you will be responsible for any loss or damage to the product during shipping.

Dead On Arrival (DOA) Product: System Failure Out of the Box

An Racemore-branded hardware product is considered DOA if it shows symptoms of a hardware failure, preventing basic operability, when you first use it after opening the box. If you believe that your product is DOA, please email info@racemore.com within 30 calendar days of the invoice date. Racemore Technical Support will determine whether the product is DOA and offer you the following options:

Replacement: Racemore, at its expense, will ship another of the same product.
Service: You may have the product repaired. However, once you choose that option, you may not request replacement of the product.

If Racemore Technical Support determines that a returned product is not DOA, Racemore will apply Racemore standard product warranty to the product. Further, if Racemore determines that you have misrepresented a returned product’s condition and that the product is not DOA, Racemore may impose a $200 handling fee.

This DOA policy applies only to Racemore-branded hardware products currently offered at the Racemore Store. As new products are offered, Racemore reserves the right to determine whether or not this policy applies. This DOA policy does not apply to third-party products that do not bear the Racemore brand name. You must call the manufacturer directly with any third-party product issues.

International Customers: If you’re an international customer and you’re outside the domestic delivery area, the standard Racemore Return and Refund Policy applies — with the exception that you’re responsible for shipping the product back to a state-side return address, plus handling, customs, and inventory liability. Since you’re responsible for the safe delivery of any product you’re returning to Racemore, we recommend that you insure it against loss.

If you discover what you believe is a product defect for any Racemore-branded product, please email info@racemore.com. If your product does have a defect, your product is covered under the terms of your product’s warranty. Please refer to the warranty information and other supporting documentation that came with your product. (See the Product Warranty section below for specific information about Racemore’ product warranties.)

Non-Racemore Branded/Third-Party Products
If you discover what you believe is a product defect for any third-party product, please contact the manufacturer of such third-party product directly for information regarding the manufacturer’s warranty. Please note that products sold through the Racemore Store that do not bear the Racemore brand name are serviced and supported exclusively by their manufacturers in accordance with the terms and conditions packaged with the products. Racemore’ Limited Warranty does not apply to products that are not Racemore-branded, even if packaged or sold with Racemore products.
